Balance of rights and fair procedures | Referendum 2011: "The amendment, if approved, says that the Houses of the Oireachtas must determine the appropriate balance between the rights of the individual and the public interest having “due regard to the principles of fair procedures”. “Fair procedures” is a general term that covers a range of rights to which individuals are entitled when their conduct is being investigated. The rights derive from the Constitution and have been developed by decisions of the courts over many years. The precise manner in which these rights must be applied depend on the particular context and may differ in particular cases."/
